What Happens When You Send King Trivia Email Communications Or Report An Indiscretion? When you contact King Trivia via email or otherwise, such as through the “Report an Indiscretion” portal on the Website, the email address you use and any other Personal Information you provide is subject to this Privacy Policy. King Trivia may collect, store and make use of this Personal Information so that King Trivia can respond to your questions or requests, communicate with you, inform you about King Trivia and its services (unless you, as discussed below, opt out of receiving these types of communications), or to send you information related to the Website and King Trivia. King Trivia may keep a record of your communications and use the contents of those communications for any purpose, without limitation, including, but not limited to, public display and advertising.

What Happens When You Sign Up Or Are Registered For The King Trivia Newsletter? Features of the Website, such as the registration of user accounts on the player app, registration for King Trivia events, or signing up for the newsletter, may require you to provide Personal Information. You may view the Website without registering for an account or submitting Personal Information, in which case the Website will be collecting non-personal information. King Trivia may use your Personal Information to send you promotional or marketing materials or newsletters and to improve the Website or King Trivia’s services. King Trivia may further use the Personal Information you provide through the Website to communicate with you, facilitate transactions with you, notify you of King Trivia’s services and events, or to solicit your feedback or input regarding King Trivia, King Trivia events, or the Website.

What Happens To Information Provided For Contests Or Promotions? It is possible that King Trivia may offer Website users or King Trivia customers the opportunity to enter promotions, contests or other opportunities on or through the Website. In order to participate in the same, you may be promoted to submit Personal Information. The Personal Information King Trivia collects from participants will be used to verify user or participant identities, facilitate transactions and Website features, and to contact participants. Also, the name or names of participants may be made available on or through the Website. Further, any named King Trivia partners or co-sponsors may use Personal Information collected to contact participants regarding goods or services they offer or to facilitate transactions. King Trivia may employ third-party service providers or websites, which may request or collect Personal Information in order to facilitate Website users’ or King Trivia customers’ entry into King Trivia promotions, contests or other opportunities. The collection of Personal Information by these third-party service providers or websites is subject to their privacy policies.

Is Any Information Automatically Collected By King Trivia? The Website’s servers automatically recognize the IP addresses of its users and may also identify a user’s computer or device, connection information for same, as well as information about the browser being used, the browser’s settings, and possibly geographic location. Your IP address is usually associated with the location from which you access the Internet. Further, King Trivia may use aggregated, non-private, or otherwise non-personal information collected as a result of the user’s access, visitation or use of the Website to analyze King Trivia’s Website use and traffic. In addition, King Trivia may use this information to diagnose problems with servers, to improve or administer the Website, to display content and advertisements, to facilitate transactions, to track how users are using the Website, and to improve King Trivia’s marketing and reporting systems. King Trivia reserves the right, for any purpose, to sell, transfer, use, share or disclose your non-private, aggregated or otherwise non-personal information, such as, but not limited to, the number of users who visit the Website or clicked on a given link, and demographic data with business partners and other third-parties on an aggregated and anonymous basis.

Does King Trivia Use Cookies? King Trivia may use “cookies” to store data on your computer or device about your visit of, use of, or access to the Website. Cookies help King Trivia learn about the Website’s performance and how visitors use the Website. King Trivia may also use cookies to deliver content specific to you, to track usage of the Website, or to save your user ID or password so you don’t have to keep reentering it each time you visit the Website. Promotions or advertisements displayed on King Trivia’s Website may also contain cookies. Cookies set by King Trivia do not contain personally identifying information. How is Information Regarding Clicked Links Used? We may keep track of how you interact with links across the Website by tracking actions taken, or through other means. This is done so that King Trivia can understand and improve the Website’s functionality and its use.

What Happens When You Choose Not To Provide Personal Information? You may choose not to provide King Trivia with Personal Information. However, your decision to refrain from providing Personal Information, or any decision to unsubscribe as set forth herein, will limit your ability to access parts or features of the Website. If you do elect to provide any Personal Information to King Trivia, we may share your Personal Information with others.

What Information Does King Trivia Provide To Its Service Providers? King Trivia engages service providers to perform functions and provide basic services (such as hosting, data, customer service, technical support, marketing assistance, mailing assistance, storage security, delivery of services and reporting services) related to the operation of the Website. King Trivia may share your Personal Information with such service providers.

What Happens to Personal Information If King Trivia Is Acquired or Merged? As an ongoing concern, King Trivia may, from time to time, buy and sell various properties and assets. In the event all or a portion of the property or assets King Trivia owns or controls is sold, transferred, assigned or acquired by another party, the information from, about, regarding or concerning Website users, including Personal Information and non-personal information, may be among any properties or assets sold, transferred, assigned or acquired.

What If You Break The Law? King Trivia may preserve or disclose, without your consent, your Personal Information if we believe that it is reasonably necessary to comply with a law or legal request (such as a court order or subpoena), or to protect the wellbeing of any person or property, or the protect any party’s rights. We may disclose your Personal Information to enforce compliance with, or to determine potential violations of this Privacy Policy, King Trivia’s DCMA Policy, and other terms and conditions of the Website, or to detect, prevent or otherwise address fraud, potential or actual Website security breaches, to enhance Website security, or to address technical issues relative to the use of the Website.

How Do I Remove Personal Information? You may notify King Trivia at any time that you wish to end King Trivia’s storage of your Personal Information, and upon receipt of that notice King Trivia will remove all information about you from King Trivia’s database. If you request the removal of Personal Information you will no longer be able to access any part of the Website or King Trivia’s services that require Personal Information or registration unless you re-register or re-provide same. Any information or content that you have posted to public areas of the Website may remain on the Website for the benefit of other users irrespective of the status of your user account, Personal Information, or your request to delete Personal Information, including, but not limited to in the event you have posted Personal Information on publicly available parts of the Website. The deletion of your Personal Information from King Trivia’s database will not cause the removal of any content you may have previously posted, uploaded or otherwise made publicly available on or through to the Website.

Can You Review Or Correct Personal Information? User’s who have provided Personal Information on or through the Website may request to review and/or correct this information by sending King Trivia an email (as listed below) or by logging into their user account and changing any information therein, where applicable. Users may also request a list of all third parties to whom King Trivia has disclosed any Personal Information for the third parties’ direct marketing purposes during the preceding calendar year, along with a list of the categories of Personal Information that was disclosed.

Can You Opt Out? Any user who wants to stop receiving King Trivia’s electronic newsletters, marketing materials, or promotions, or any offers or other correspondence from King Trivia may opt out of King Trivia’s email list at any time by following the “Unsubscribe” instructions contained in any email you receive from King Trivia, or by sending an email from the account you wish to unsubscribe with the word “Unsubscribe” in the subject line to King Trivia at contact@kingtrivia.com.

Is Your Personal Information Secure? No form of data transmission over the Internet can be made completely secure, and no system of security is entirely invincible. King Trivia takes reasonable measures to protect data, including Personal Information, on King Trivia’s servers from destruction, disclosure, loss, misuse, unauthorized access, damage, or unauthorized alteration, taking into account the given level of risk and the type of data under the circumstances. However, King Trivia does not guarantee the security of any information you send to King Trivia or the security of King Trivia’s servers or databases. By using the Website, you assume all risk in connection with the information sent to King Trivia or collected by the Website. You are also responsible for taking reasonable precautions on your own behalf to protect unauthorized access to any account you may have registered with the Website.

How Does King Trivia Respond To “Do Not Track” Signals? The Website does not respond to “DNT” or “Do Not Track” signals.

PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

This Privacy Notice for California Residents supplements and, to the extent it directly conflicts with, supersedes the above privacy policy, but applies solely to all users, visitors, and others residing in California (”consumers” or “you”). To comply with the California Consumer Privacy Act of 2018 (CCPA), King Trivia has adopted this notice. Any terms defined in the CCPA that are used in this notice connote solely the CCPA definition.

Information We Collect

As discussed above, the Website collects Personal Information (defined above in the “Privacy Policy”). However, Personal information does not include:

  • information from government records or publicly available information;
  • aggregated consumer information or De-identified information;
  • Information not included within the scope of the CCPA, such as:
  1. Medical or health information governed by the California Confidentiality of Medical Information Act (CMIA) and the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and/or clinical trial data; or

King Trivia obtains the above listed categories of personal information from the following categories of sources:

  • Indirectly from you. For example, from monitoring your usage of an actions on the Website or your interactions with the Website’s advertisers.
  • Directly from you. For example, from answers to forms you complete on the Website.

Use of Personal Information

We may disclose or otherwise use the personal information we collect for any and all of the following business purposes:

  • To respond to your questions and support to you, including to addressing or investigating issues and concerns, as well as to improve and monitor King Trivia’s responses;
  • As described by King Trivia to you when collecting your personal information or as otherwise set forth in the CCPA.
  • To meet of carryout the reason you provided the information. For example, if you share your contact information and name to ask a question about our services, in order to response to that inquiry, King Trivia will use that personal information. If you provide your personal information to acquire our services, in order to process your payment and provide those services, King Trivia will use that information. King Trivia may also, to facilitate future commercial transactions with you, save your information;
  • To respond as required by applicable law, including, but not limited to court orders, subpoenas, law enforcement requests, or governmental regulations;

King Trivia does not collect additional categories of personal information or use the personal information we collected for materially unrelated, incompatible, or difference reasons without providing you notice.

Sharing Personal Information

King Trivia may disclose your personal information to third parties for a business purpose, or sell your personal information, subject to your right to opt-out of those sales (see below, Personal Information Sales Opt-Out and Opt-In Rights). If King Trivia discloses personal information for a business purpose, King Trivia will have entered into a contract describing the purpose and requiring the recipient to keep that personal information confidential and also to not that personal information for any purpose except as in the course of performing the contract. Third parties are prohibited by the CCPA from purchasing personal information from King Trivia for resale unless you have received explicit notice of this intention and an opportunity to opt-out of further sales.

We share your personal information with the following categories of third parties: (1) Web-based email marketing services; and (2) Online payment system services and online money transfers services

Your Rights and Choices

Consumers (i.e. California residents) are provided with specific rights under the CCPA regarding their personal information. Your CCPA rights and how to exercise same with respect to the Website are described and explained below.

Access to Specific Information and Data Portability Rights

You have the right to request that King Trivia disclose certain information to you about King Trivia’s use and collection of your personal information over the preceding 12-month period. Once King Trivia receives and confirms your verifiable consumer request, King Trivia will disclose to you:

  • The categories of sources for the personal information King Trivia collected about you;
  • The categories of third parties with whom King Trivia shares that personal information;
  • The categories of personal information King Trivia collected about you;
  • The specific pieces of personal information King Trivia collected about you (also called a data portability request);
  • King Trivia’s business or commercial purpose for collecting or selling that personal information;
  • If King Trivia sold or disclosed your personal information for a business purpose, two separate lists disclosing: (1) sales, identifying the personal information categories that each category of recipient purchased; and (2) disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.

Deletion Request Rights

You have the right to request that King Trivia delete any or all of the personal information that King Trivia collected from you and retained, subject to certain exceptions. Upon King Trivia’s receipt and confirmation of a verifiable consumer request from you, King Trivia will, unless an exception applies, delete (and direct any of our service providers having such information to delete) your personal information from King Trivia’s records.

Under certain conditions, King Trivia may deny your deletion request. Namely, King Trivia may deny your request for deletion if retaining the information is necessary for King Trivia or our service provider(s) to:

  • Protect the website and detect security incidents, including preventing fraudulent, deceptive, malicious, or illegal activity, or to enforce the law against those responsible for such actions.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.);
  • Adhere to any legal obligation;
  • Provide a good or service you have requested, complete a transaction for which King Trivia has collected the personal information, to perform any contract with your, or to take any other steps reasonably anticipated within the context of King Trivia’s ongoing business relationship with you;
  • Participate in peer-reviewed or public historical, scientific, or statistical research in the public interest that adheres to all other applicable privacy laws and ethical constraints, when the information’s deletion may likely seriously impair or render impossible the research’s achievement, if you previously provided informed consent;
  • Exercise any right provided for by law, including the exercise free speech, and to ensure the right of another consumer to exercise their free speech rights;
  • Troubleshoot or debug products, including to identify and repair errors and intended functionality impairments;
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
  • Make other lawful and internal uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

To exercise your access, data portability, and deletion rights described above, please submit a verifiable consumer request to King Trivia by sending an email to King Trivia at contact@kingtrivia.com, by mailing King Trivia at King Trivia, Inc., P.O. Box 985, Woodland Hills, CA 91365, by sending King Trivia a message on through our webpage, or by calling toll free (888) 857-8388. Only you, or a person registered with the California Secretary of State authorized by you to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

A verifiable consumer request for access or data portability may be made by you only twice within a 12-month period. The verifiable consumer request must:

  • Describe your request with sufficient detail allowing us to properly evaluate, understand, and respond to it; and

 

  • Provide sufficient information that allows King Trivia to reasonably verify that you are the person about whom King Trivia collected personal information or an authorized representative.

King Trivia cannot provide you with personal information or respond to your request if King Trivia cannot verify your identity or authority to make the request and confirm the personal information relates to you. King Trivia will only use personal information provided in a verifiable consumer request to verify the requestor’s authority to make the request or identity.

Response Timing and Format

King Trivia makes efforts to respond to a verifiable consumer request within 45 days of its receipt.  If we require more time (up to 90 days), King Trivia will inform you of the reason and extension period in writing. If you have an account with the Website, King Trivia will deliver its written response to that account. If you do not have an account with us, or a response is not capable of being sent thereto, King Trivia will deliver our written response by mail or electronically, at your option.  Any disclosures King Trivia provides will only cover the 12-month period preceding the verifiable consumer request’s receipt. If applicable, the response King Trivia provides will also explain the reasons King Trivia cannot comply with a request. For data portability requests, King Trivia will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

Unless it is repetitive, excessive, or manifestly unfounded, King Trivia does not charge a fee to process or respond to your verifiable consumer request.  If King Trivia determines that the request warrants a fee, King Trivia will provide you with a cost estimate before completing your request tell you why it made that decision.

Personal Information Sales Opt-Out and Opt-In Rights

If you are 16 years of age or older, you have the right to direct, at any time, King Trivia to not sell your personal information (the “right to opt-out”). King Trivia does not sell the personal information of consumers actually known to King Trivia to be less than 16 years of age, unless King Trivia has received affirmative authorization (the “right to opt-in”) from either the consumer who is between 13 and 16 years of age, or the parent or guardian of a consumer less than 13 years of age. Consumers who opt-in to personal information sales may, at any time, opt-out of future sales. To exercise the right to opt-out, you (or your authorized representative) may visit the “Manage My Info” webpage, submit a request to King Trivia by emailing King Trivia at contact@kingtrivia.com or by mailing King Trivia at King Trivia, Inc., P.O. Box 985, Woodland Hills, CA 91365.

Once you make an opt-out request, King Trivia will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sales at any time by visiting our website and sending us a message to that effect. King Trivia will only use personal information provided in an opt-out request to comply with and review the request.

Non-Discrimination

King Trivia will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

  • Deny you goods or services;
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
  • Provide you a different level or quality of goods or services; or
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, as permitted by the CCPA King may offer you certain financial incentives that can result in different rates, prices, or quality levels. Any CCPA-permitted financial incentive King Trivia offers will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. In order to participate in a financial incentive program, you will be required to provide opt in consent, which you may revoke at any time.

Under California’s “Shine the Light” law (Civil Code Section § 1798.83), users of the Website that are California residents are permitted to request certain information regarding our disclosure to third parties of personal information for their direct marketing purposes. To make such a request, please send King Trivia an electronic message through our website or write us at our address listed on our webpage.
